Please read this document carefully. It affects your legal rights, including your right to sue TEN33 Fitness. By submitting this form, you are agreeing to release TEN33 Fitness from liability and to waive certain legal claims.
1. Acknowledgment of Risk
I understand that participation in fitness activities, training sessions, classes, and use of equipment and facilities at TEN33 Fitness ("the Gym") involves inherent risks of physical injury, including but not limited to strains, sprains, fractures, cardiac events, and, in rare cases, permanent disability or death. I acknowledge these risks exist even when proper technique, instruction, and equipment are used.
2. Assumption of Risk
I voluntarily choose to participate in activities at TEN33 Fitness and knowingly and freely assume all such risks, both known and unknown, including risks that may arise from the negligence of the Gym, its owners, employees, trainers, contractors, and agents (collectively, "Released Parties"), and I assume full responsibility for my participation.
3. Release of Liability and Covenant Not to Sue
I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in activities at the Gym or while on the premises.
4. Medical Condition Acknowledgment
I certify that I am physically fit and have not been advised otherwise by a physician. I understand it is my responsibility to consult a physician prior to beginning any exercise program. I certify that I have no medical condition that would prevent my safe participation, except as noted below, and I agree to inform staff of any condition that may affect my ability to exercise safely.
5. Indemnification
I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including attorneys' fees, that they may incur due to my participation in activities at the Gym, whether caused by my negligence or otherwise.
